Agreement

These terms are an agreement between you and CHZ Development LLC ("Everforest," "we," "us") for the Everforest app and the website everforest.app. By using either, you accept them.[review]Our Privacy Policy explains how we handle your information. If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies, and where the two differ for the app, these terms govern to the extent Apple allows.

You must be at least 13 to use Everforest. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.

The product

Everforest identifies plants from photos, gives care guidance and reminders, flags plants that are toxic to cats and dogs, and grows a grove in the app that reflects the trees your scans earn. Some features need Pro. We may add, change or remove features.

Your account

The app creates an anonymous account on your device. If you don't link Sign in with Apple and you lose or reset your phone, we may not be able to recover your account, plant list or grove. You're responsible for what happens under your account.

Subscriptions and billing

  • Pro costs $39.99 a year, with a 7-day free trial, or $9.99 a month with no trial. These are US prices; the App Store shows the price in your country before you buy.
  • Apple bills your Apple ID. Subscriptions renew automatically at the same price and period until you cancel. Cancel at least 24 hours before the end of the current period (or the trial) to avoid the next charge.
  • A free trial turns into a paid annual subscription when it ends unless you cancel at least 24 hours before. We send a reminder in the app before your trial ends.
  • Cancel anytime in Settings → [your name] → Subscriptions on your iPhone. You keep Pro until the end of the period you paid for.
  • Refunds are handled by Apple, not by us: request one at reportaproblem.apple.com.
  • Restore purchases from Settings in the app.
  • If we change a subscription price, Apple notifies you and, where required, asks for your consent before the new price applies.

Trees

Everforest buys tree-planting services from its vendor per tree. As part of operating the product, we buy them from a third-party planting vendor, currently The Good API, whose partner organizations plant and verify the trees.

This is not a donation, and nothing you pay us is tax-deductible.

Everforest is not a charity and does not raise money for one.

Everforest is a for-profit company and does not solicit or collect charitable contributions.

We never ask you for money for trees. Your subscription pays for the app; how many trees we buy follows the rules below, and the cost is ours.

  • How trees are earned. Every 10 qualifying scans earn one tree. A qualifying scan is a clear photo of a real plant that isn't a repeat of one you scanned in the last 30 days; on Free, only the first 20 scans each day count. Pro earns one more tree each paid month.
  • Monthly caps. Scan-earned trees are capped each calendar month (UTC): 3 on Free and 10 on Pro. Scans past the cap still work but earn no trees that month, and unused trees don't carry over.
  • Ordering. Trees you earn wait in a queue until our nightly order. Planting happens in the vendor's next planting cycle, which can be weeks or months later.
  • What the numbers mean. A tree shown as "planted" is one we have ordered and paid for. "Verified" means the vendor's partner confirmed the planting; we post that evidence on the public ledger when the vendor reports it.
  • Changes. We may change the planting vendor, the project or country, the price we pay, or these rules. Changes apply going forward; trees already ordered are not taken back.
  • You don't own the trees or any land, carbon or other rights connected with them, and trees have no cash value.

We make no carbon or offset claims: a tree ordered through Everforest does not cancel your own emissions.

Invites and referrals

  • When someone joins with your invite code and earns their first tree, you each get one extra tree. Each person can be invited once, and only before their first tree.
  • You can earn up to 10 invite trees a month.
  • Invites must be real people. Codes used with fake or duplicate accounts, automated scans or other abuse are voided, along with the trees they earned, and we may disable a code.

Acceptable use

Don't:

  • use bots, scripts, emulators or repeated photos to earn scans or trees;
  • copy, scrape, resell or reverse-engineer the app or its data, except where the law allows it;
  • upload photos of people, private documents or anything unlawful;
  • interfere with the service, other users, or our partners' systems.

We may limit, suspend or close an account that breaks these rules.

Your photos and content

Your photos stay yours. You give us permission to send each photo to our identification partners to answer your scan. They process it under their own terms, which the Privacy Policy quotes and links. Nicknames you choose must not be offensive or impersonate someone.

Plant care and safety

  • Identification can be wrong. Everforest shows a confidence for every result; treat it as a best guess, not a fact.
  • Care guides and plant health explanations are general guidance. Some are written with the help of AI and can contain mistakes.
  • Never eat, drink, or use a plant as medicine, or touch an unknown plant, because of anything in Everforest.The app does not tell you whether a plant is edible or safe for people, and mushrooms and other fungi are not identified.
  • Pet toxicity flags for cats and dogs come from data published by the ASPCA Animal Poison Control Center. A missing flag does not mean a plant is safe. If your pet may have eaten a plant, call your veterinarian or the ASPCA Animal Poison Control Center right away. The ASPCA is not affiliated with Everforest and does not endorse it.

Disclaimers and liability

Everforest is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, plants or profits, and our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or $50.

Some places don't allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in Orange County, California, unless the law where you live gives you the right to bring them there.

Changes and ending these terms

We may update these terms. When we do, we change the date at the top, and for meaningful changes we tell you in the app before they take effect. If you keep using Everforest after that, the new terms apply. You can stop at any time by deleting your account and cancelling any subscription.
